Sena vs Sena: Supreme Court to consider listing plea of Thackeray faction against speaker’s order | India News

NEW DELHI: The Supreme Court on Monday has agreed to review a plea submitted by the Uddhav Thackeray faction contesting Maharashtra assembly speaker Rahul Narwekar‘s ruling, which declared the Shiv Sena bloc led by Eknath Shinde as the authentic political entity following their split in June 2022.
A bench comprising Chief Justice D Y Chandrachud and Justices JB Pardiwala and Manoj Misra acknowledged the arguments presented by senior advocate Kapil Sibal, representing the Thackeray faction, that the plea slated for Monday’s listing had not been addressed.
“We will consider it,” remarked the Chief Justice.
Earlier on January 22, the apex court had served notices to Chief Minister Shinde and other legislators from his group regarding the Thackeray faction’s challenge against the speaker’s decision. The court then scheduled a hearing after a fortnight.
The Thackeray faction has accused Shinde of “unconstitutionally seizing power” and leading an “unconstitutional administration.”
In a verdict issued on January 10, Speaker Narwekar also dismissed the Thackeray faction’s appeal to disqualify 16 MLAs from the ruling coalition, including Shinde.
Contesting the Speaker’s rulings, the Thackeray faction asserts they are “blatantly unlawful and biased,” contending that instead of penalizing defection, the decisions reward defectors by recognizing them as the political party.
