Government questions maintainability of plea in HC for stay on FCU | India News

MUMBAI: Centre on Wednesday opposed a plea before Bombay high court to continue its statement against notifying Fact Checking Unit (FCU). In its reply before the high court, Centre questioned the very maintainability of an application filed by stand-up Comedian Kunal Kamra seeking a stay on the amended rule under the Information Technology Act.
The rule empowers Centre to set up a Fact Checking Unit to flag as fake, false or misleading content related to Centre’s business posted online.
In the reply submitted by solicitor general Tushar Mehta, Centre said divergence of views by the high court’s division bench has to be and ought to be treated as divergence of views on the question of interim relief sought by petitioner. Only the third judge can take a call on the question of interim relief now, Centre said.
The Centre said the plea for a stay is not maintainable before the high court bench, which has already pronounced a split verdict on the validity of the provision. The high court will continue hearing the matter on Thursday.
