AHMEDABAD: Differences of opinion on a two-judge Gujarat high court bench took an acrimonious turn on Monday when the presiding member openly sparred and ticked off the other before retiring to his chamber in a huff.
The discord flared during a hearing on taxation-related cases, with a senior member of the Gujarat high court advocates’ association (GHAA) calling it “rare”.
During the hearing, the senior judge expressed dissatisfaction with the junior judge’s conduct, particularly her tendency to disagree with his viewpoint. Dictating an order, the senior member told the junior judge: “Then you differ here.” As the junior tried to explain herself, the senior judge interjected: “You have differed in one matter, then differ in another.”
The junior member continued to explain, “It is not a question of difference…” But the senior member retorted angrily: “Then don’t murmur.”
As the junior member continued explaining, saying “it is not a question of difference”, the senior lost his temper and said: “Then pass a separate order. We are not taking any other matter.” He got up and went to his chamber.
Sources said the bench assembled again in the post-lunch sessions and heard the cases. According to the GHAA member, judges not finding common ground is nothing new and recording dissenting views by junior judges is common, but it is unusual for such disagreements to be aired openly and rancorously.
