9 of 11 Bilkis convicts seek more time to surrender, cite ill health, family duties | India News

NEW DELHI: Days after Supreme Court annulled the remission granted to 11 convicts in the Bilkis Bano case and asked them to surrender within a fortnight, nine of them moved the court Thursday and sought extension of time. They cited various reasons, including medical problems and family responsibilities. SC agreed to hear their pleas on Friday subject to CJI’s approval, and directed the registry to take instruction from CJI on listing of the matter.
In an application seeking four more weeks to surrender, PR Modhiya said he had undergone lung surgery and required regular consultation with doctors.Another convict, Govindhbhai Nai, also cited ill health for seeking extension.
Convict Govindhbhai Nai said he underwent an angiography recently and was to undergo another operation for the treatment of “haemorrhoids”.
The plea of another convict, PR Modhiya, reads, “The applicant’s wife died due to kidney failure. She was working as a teacher and pursuant to her death, some departmental procedure is due pertaining to her service benefits which will be given to the surviving members. The applicant, being the only member at home, has to complete the procedure”.
Among the nine who sought similar relief are Bipin Chandra Joshi, Ramesh Chandana and Mitesh Bhatt.
On Jan 8, the SC had quashed Gujarat government’s decision to grant remission to 11 convicts who gangraped Bilkis and killed 14 of her family members during the 2002 communal riots and directed them to surrender before the jail authority, one-and-a-half years after they were granted liberty.
Allowing the plea of Bilkis who had challenged their remission, a bench of Justices Nagarathna and Ujjal Bhuyan had found fault not only with the decision taken by the Gujarat government but also with the order passed by the apex court in 2022 which triggered the remission process as the SC had directed the state to decide the plea for one of the convicts. The court said the state acted on the basis of the direction issued by the SC but contrary to the letter and spirit of law.
