Shiv Sena: Shiv Sena MLAs disqualification, cross examination to begin before Narwekar on November 21 | India News

MUMBAI: During the hearing of the Shiv Sena MLAs disqualification before Assembly Speaker Rahul Narwekar on Thursday, the Shinde faction claimed that their MLAsdidn’t receive any whip from the party for voting in July 2023. The Uddhav faction hit back saying that the whip was issued by MLA Sunil Prabhu and sent on the official email ids of the MLAs which was on record in the party’s legislature office.The next hearing of the MLAs will be held on November 21 when cross examination will begin. Officials said that the first witness will be examined on November 21 and both factions have been asked to submit ‘common convince compilation’ documents and evidence by November 6 and 16 respectively. On Monday, expressing unhappiness over the inordinate delay, the court said that pleas filed byShiv Sena factions should be decided by December 31 and those filed by the NCP factions be disposed of by January 31 next year.
Thursday’s hearing was attended by the Uddhav faction’s MP Anil Desai, MLAs Sunil Prabhu and Ajay Chaudhary and MLC Anil Parab. Officials said that there was an argument between Uddhav and Shinde faction’s over the whip on e-mail. “The Uddhav faction claimed that 16 MLAs of Shinde faction were issued a whip through email. The Uddhav faction claimed that they had submitted related evidence. But the Shinde faction’s lawyers claimed that the email on which the whip was sent was not theirs. They claimed that because they didn’t get the whip they didn’t violate it,” said an official.
Desai said that the whip was issued via email on the official ids of the MLAs. “The Shinde faction claimed that they didn’t get the whip. We have already laid out the details in the petition, the whip was sent on the official email id. They have in the past admitted that the whip was illegal since it wasn’t given by an authorised person. So they have admitted that they got the whip. We have asked us to allow evidence to be given on record regarding this. The whips were issued on July 2 and 4, 2022. One was asking MLAs to vote for Rajan Salvi who was our candidate for the post of Speaker, the second one was to vote for the party in the vote of confidence. They violated both these whips and they have incurred disqualification. There was an argument over this. The SC has also asked to submit a common compilation of admission and denial, so that was accepted,” Desai said.
“The Speaker has said that he will take a decision on holding day to day hearings and has said that a decision will take before December 31. The Speaker also said that like here in Mumbai, hearings can also be taken in Nagpur,” Desai said.
However officials said that the Uddhav faction was first against allowing giving evidence but now wanted to allow leading of evidence. They were also against holding the hearing based on the Civil Procedure Code (CPC) but now they claimed the hearings must be held as per CPC, officials said.
Last month, Narwekar had decided to club the 34 petitions in the disqualification case into the six groups based on the cause of action. Of the six groups, four groups have petitions filed by the Sena (UBT) and two groups have petitions filed by the Eknath Shinde-led Sena.
