RAIPUR: Chhattisgarh high court has ruled that the state government’s notification issued in 2013 exempting the Anti-Corruption Bureau (ACB) from operation of Right to Information (RTI) Act would not prevent the public information officer from supplying information related to allegations of corruption and human rights violation.
A division bench, comprising Justice Sanjay K Agrawal and Justice Radhakishan Agrawal, held that the general administration department (GAD) notification prevents the disclosure of information concerning the ACB, even when it pertains to allegations of corruption and human rights violations, which would be contrary to Section 24(4) of the RTI Act, 2005. The court directed the GAD secretary to issue a clarificatory notification within three weeks. The authority was also instructed to reconsider the case of the petitioner, Rajkumar Mishra from Chirmiri, for the grant of information within four weeks, in accordance with the law.
