Embassy Group: Bombay HC issues notice to complainant in quashing plea filed by Embassy group | India News

MUMBAI: In a quashing petition filed by Embassy Energy Pvt Ltd and Jitendra Virwani, Managing Director of Embassy Property Developments Pvt Ltd and an ex-nominee director in an alleged cheating and criminal breach of trust case filed against them by the Economic Offences Wing (EOW) of Mumbai police, the Bombay high court on Wednesday issued notice to the complainant.
V J Rao, authorized representative fo Sterling & Wilson Renewable Energy Pvt Ltd had lodged a first information report (FIR) at the Deonar police station against Virwani and the Bangalore based Embassy group company alleging on March 23. The case was later transferred to the EOW.
The petitioner’s counsel Satish Maneshinde seeking interim relief against any coercive steps by the EOW argued before a bench of Justices N W Sambre and R N Laddha that there is no criminal case made out against his clients which owns and operates a 100 MW solar power unit in Bellary, Karnataka. He also submitted that the Contract on turn key basis was awarded to a subsidiary of ILFS by Embassy and Sterling was a sub contractor of ILFS. There was no privity of contract between Embassy and Sterling, he submitted.
Senior counsel Amit Desai for Sterling, a sub-contractor, claimed money was due to it for certain work done on a commitment made. He said Embassy had directly come to it during the moratorium of IL&FS and made a commitment based on which it completed the work.
The HC posted the matter to September 11 when it would decide on interim relief plea.
