NEW DELHI: The Election Commission on Wednesday issued notices to Congress spokesperson Supriya Shrinate and BJP MP Dilip Ghosh for allegedly violating the model code of conduct with their “offensive” and “undignified” posts/remarks against actress and BJP candidate from Mandi Kangana Ranaut and West Bengal chief minister Mamata Banerjee respectively.
While the posts from Shrinate’s social media handles had taken an undignified dig at Bollywood actress Ranaut’s candidature from Mandi (Mandi being a slang associated with immoral traffic after massive backlash from social media users against her posts on Kangana, Shrinate had deleted them and claimed it was the doing of one of the many persons who have access to her social media accounts), Ghosh had stirred the hornet’s nest by commenting on Mamata’s parentage. After the massive backlash from social media users against her posts, Shrinate had deleted them and claimed it was the doing of one of the many persons who have access to her social media accounts.
Unmoved by her claims, BJP and the National Commission for Women (NCW) had on Tuesday filed a complaint with EC against Shrinate. TMC too approached the poll body seeking action against Ghosh.
In its notice to Shrinate, EC said her comment was found to be “undignified and in bad taste” and prime facie violative of the…model code of conduct and commission’s advisory dated March 1, 2024. The poll body asked her to reply to its notice by 5 pm on Mar 29, showing cause why appropriate action should be taken against her.
Similarly, the commission in its notice to Ghosh, said his comment was found to be “offensive, insulting” and prima facie violative of the model code and EC advisory dated Mar 1, 2024. The Medinipur MP was also directed to send in his response by 5 pm on Mar 29.
In both the show-cause notices issued on Wednesday, EC cited the model code provision that requires criticism of other political parties and candidates to be confined to their policies and programmes, past record and work and not touch one’s private life or be based on unverified allegations or distortion. The notices refer to another MCC provision that restrains party leaders and candidates from making statements attacking the personal life of a rival and which may be malicious or offending decency and morality.
EC also reminded Shrinate and Ghosh of its advisory dated Mar 1, 2024, which had cautioned parties and their leaders against plummeting levels of political discourse. The advisory asked the parties and their campaigners to avoid low-level personal attacks to insult rivals, particularly deeds/actions/utterances that may be construed as repugnant to the honour and dignity of women.
The poll watchdog also cited past court judgments stating that freedom of speech cannot be licence to hurt the sentiments of others or freely indulge in character assassination during election.
