NEW DELHI: Challenging the election of Chandigarh mayor in which the BJP candidate was declared winner, Aam Aadmi Party councillor Kuldeep Kumar, who lost in the fray, moved the Supreme Court and requested the Chief Justice on Friday for an early hearing.
Senior advocate Abhishek Manu Singhvi mentioned the case before a bench headed by CJI D Y Chandrachud and told the court that he had to approach the apex court as the high court listed the case after three weeks. The CJI told him to mail it to the concerned registrar and assured him that he would take a call in the afternoon. BJP candidate Manoj Sonkar was elected as the Mayor on January 30 after he bagged 16 votes against the 12 votes of the Congress-AAP joint candidate Kumar and eight votes that were declared invalid. Immediately after the election, Kumar moved Punjab and Haryana high court which on Wednesday issued notice on his plea and listed the case after three weeks.
Alleging forgery in rejection of the eight votes which proved crucial in deciding the election, Kumar prayed before the HC for fresh election in a free and fair manner under the supervision of a retired high court judge.
“The presiding officer in the most flimsy manner addressed to the House that he does not want any assistance from the members nominated by the parties contesting the election and he will count the vote himself. The voices were raised by the Aam Aadmi Party and Congress but their requests were not heeded, but surprisingly the Deputy Commissioner, Respondent No.2 and the Prescribed Authority, who was also in the same capacity in the last year’s election remained mum,” the petition said.
