High court gives Kerala Jan 23 deadline to attach PFI assets | India News



The Kerala high court on Wednesday gave an ultimatum to the state government to attach properties of the Popular Front of India (PFI) and its leaders, and ordered that the action be completed and compliance reported to the court by Monday (January 23).
A division bench of Justices A Jayasankaran Nambiar and Mohammed Nias CP also said the government went wrong in deciding to issue notices to PFI leaders before attaching their properties. It went on to add that it was not required as attachment was ordered by the HC when PFI failed to deposit Rs 5. 20 crore for the loss caused to public and private properties in the illegal hartal on September 23, 2022.
When the court asked why notices were being served on the PFI leaders, the state attorney submitted that as recovery proceedings were ordered to be initiated under the Revenue Recovery Act, the government felt that compliance with the procedure under itwas necessary.
Stating that it was an erroneous appreciation of the court’s directions of December 23 by the government, the HC said: “We are of the view that the government should have straightaway proceeded to attach the properties and bring the same for realisation of the aforesaid amount of Rs 5. 20 crore by following the procedure under Section 35 of the Revenue Recovery Act. . . ”
